Terms of Service

1. Acceptance of Terms

WheelOurNames (wheelournames.com) is operated by Mujafet Osmani as an independent sole operator. WheelOurNames is the product brand; Mujafet Osmani is the operator behind it.

By accessing or using our interactive tools and website (the "Service"), you automatically agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Service.

2. Eligibility

You must be legally capable of forming a binding contract under the laws of your jurisdiction to use the Service. Minors may use the Service only under the supervision of a parent, guardian, or qualified educator.

3. Description & Permitted Use

Free Service. WheelOurNames is a browser-based random picker wheel and related spinner tools (the "Tools") — including the name wheel, yes/no wheel, number wheel, team generator, decision wheel, classroom and giveaway wheel. These core Tools and the other functionality identified as free on the site remain free. No account is required to create or spin a wheel; signing in is optional and only enables saving wheels to the cloud. The free Tools may be used for purposes including:

1. Personal use and everyday decision-making
2. Entertainment and casual decision-making
3. Educational and classroom activities
4. Group icebreakers, raffles, and informal draws
5. Business and professional use, including giveaways, promotions, retail and event draws, team meetings, and live streaming or on-screen use (for example on Twitch, YouTube, or via OBS)

We do not charge for these uses and do not restrict the Tools to non-commercial use. You remain responsible for complying with any laws, platform rules, or promotion/sweepstakes regulations that apply to your own draw or event.

Paid Service. WheelOurNames Pro is an optional recurring subscription for branded embeds. Its current benefits are limited to removing WheelOurNames attribution from embedded wheels, adding the subscriber's own logo to embedded wheels, and saving and managing persistent branded embeds. The free Service remains available without a Pro subscription.

4. User Content

Any entries, lists, or customizations you create remain your responsibility. You agree not to input content that infringes on the rights of others, violates privacy, or is unlawful. By default, your entries are stored locally in your browser and are not transmitted to our servers. If you choose to save a wheel to the cloud, the wheel data you explicitly save is transmitted to and stored by our cloud service under your account.

5. Prohibited Activities

You are strictly prohibited from:

1. Scraping, harvesting, or mass-extracting our website databases, content, or assets
2. Reverse-engineering, decompiling, exploiting, or tampering with our code scripts or application logic
3. Flooding our application servers with automated bots, denial-of-service attacks, or abusive rate-based traffic
4. Using the Service for unlawful, harassing, defamatory, infringing, or otherwise harmful purposes
5. Circumventing or attempting to circumvent any security, access, or usage controls
6. Misrepresenting your affiliation with us or impersonating another party

6. Intellectual Property

All elements of the Service, including but not limited to visual code logic, UI design structures, branding text, graphics, copy, presets, and database architectures, remain the exclusive intellectual property of our platform. You are granted a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purposes. No derivative works, redistribution, or commercial exploitation is permitted without prior written consent.

7. Third-Party Services & Links

The Service relies on a small number of third-party providers — our hosting provider, a web font service, and, if you choose to sign in, an authentication and cloud-storage provider (including Google Sign-In if you select it). The Service does not currently include advertising. It uses Google Analytics, which loads only after you consent to analytics. We are not responsible for the content, terms, or practices of any third-party service, and your use of one is subject to that party's own terms.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or 100% server uptime. While our randomizers use cryptographically secure randomness, we make no guarantee of suitability for high-stakes draws, regulated gambling, or official prize awards.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Service. Where liability cannot be excluded, it is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless the platform, its operators, and affiliates from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from your misuse of the Service or breach of these terms.

11. Modifications of the Service

We reserve the right to modify, adjust, suspend, or discontinue any feature, preset, Tool, or game variation at any time, with or without prior notice, and without liability.

12. Modifications of These Terms

We may update these Terms from time to time. The current version is always available on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, third parties, or the Service itself.

14. WheelOurNames Pro — Subscriptions, Billing & Refunds

Operator. The Service is provided by Mujafet Osmani, independent sole operator of WheelOurNames (wheelournames.com). "WheelOurNames", "we" and "us" in these Terms refer to that operator and product brand, not to an incorporated company or other separate legal entity.

Merchant of Record. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid WheelOurNames Pro transactions are processed through Paddle. As Merchant of Record, Paddle handles the payment transaction, calculates and collects applicable transaction taxes where required, and issues the relevant payment receipt or invoice. Complete card or bank details are entered into Paddle's checkout and are not received or stored by WheelOurNames. Customers may also contact WheelOurNames at contact@wheelournames.com for product or billing assistance.

What is paid. WheelOurNames Pro is optional and currently costs $9 per month or $79 per year, plus applicable taxes. There is no free trial. The three current Pro benefits are removing WheelOurNames attribution from embedded wheels, adding the subscriber's own logo to embedded wheels, and saving and managing persistent branded embeds.

Recurring billing and automatic renewal. Pro is a recurring subscription. Monthly subscriptions renew monthly and annual subscriptions renew annually. The applicable recurring charge is disclosed before purchase, and the subscription continues until cancelled.

Agreement at purchase. By purchasing or subscribing to Pro, you agree to these Terms of Service, the WheelOurNames Refund Policy, the recurring charge disclosed at checkout, and the applicable Paddle buyer terms presented as part of the transaction.

Cancellation. You may cancel at any time through Paddle's hosted billing-management portal, which you can reach from our pricing page while signed in. Cancellation stops future renewals. Where cancellation takes effect at the end of the current billing period, Pro features remain available to you until that paid period ends and then stop. Once your entitlement ends, paid features are no longer accessible, while the free Service remains available.

Price changes. We may change subscription prices or plans in the future. Existing subscriptions will be handled according to the purchase and subscription terms that apply to them, including any notice or other protection required by Paddle's terms or applicable law. Price changes are not applied retroactively to a period already paid for.

Taxes. As Merchant of Record, Paddle calculates, collects and remits applicable transaction taxes where required. Prices shown on our pricing page are exclusive of such taxes unless stated otherwise at checkout.

Refunds. Refunds are governed by our Refund Policy, Paddle's applicable buyer terms and refund policy as Merchant of Record, and any mandatory consumer rights available to you under applicable law, which these Terms do not limit or waive. Paddle may independently process refunds or statutory withdrawal requests where applicable. Cancelling a subscription does not by itself entitle you to a refund of a period already paid for.

Non-payment. If a renewal payment fails and is not resolved, Pro access may be suspended or ended.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of North Macedonia, without regard to its conflict-of-laws principles. The parties agree to attempt to resolve any dispute informally before initiating formal proceedings.

16. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and us regarding the Service.
